TERMS AND CONDITIONS

 

  • The term "Guest" shall include but is not limited to any person purchasing the food, beverages and gaming coupons/chips on the date or allowed to visit the casino on a complementary basis, buying the entry ticket or invited by Golden Island Hospitality Pvt. Ltd.  (“The Company”) in the casino indicated on the relevant document, on behalf of themselves or others in their care.
  • The right to admission is reserved with the management.
  • Casino will be closed between 12 AM to 11:59 PM on every Poya Day (Full Moon).
  • Guests of Sri Lankan nationality are required to pay the mandatory entry fees as per the regulations of Govt of Sri Lanka.
  • Entry to the casino may be denied (irrespective of a valid confirmed booking) in the event of bad weather conditions, government regulation, law and order situation and or any other force majeure situation (as the case may be). In such an event, Guests are entitled to a refund of monies paid by him/her towards the booking. Guests are not entitled to claim any other expenses/compensation of any nature whatsoever.
  • The permissible age for entry on the casino floor is a minimum of 21 years. Any Guest under the age of 21 years will not be allowed entry into the casino Entry for Guests under the age of 21 years shall be restricted only to the restaurant and/or non-gaming areas. Guests under the age of 21 must be accompanied by their parents or natural guardian.
  • A valid government photo ID should be carried for verification before entering the casino. A valid passport is a must for all international Guests coming to the casino and all international Guests are mandatorily required to furnish the same upon request.
  • Dress Code for entry into the casino is either formal or smart casual. Short pants, sleeveless t-shirts, flip-flops and sandals for male Guests is strictly prohibited.
  • Guests entering any property of The Company with their face covered due to religious, health or any other reasons must abide by the rules and cooperate with the staff, security, and management to uncover their faces whenever asked to for the purposes of identification at any point of time while in the premises of the Company properties.
  • Backpacks, laptop bags, and bags of larger sizes are prohibited at the gaming area and the same may be deposited by the Guests, by availing of the locker facilities which are set-up at the reception, subject to availability. Further, Guests are not permitted to carry laptop, pen-drive, camcorder, DSLR, any sort of recording, relying or transmitting device, etc. on the gaming floors of the casino. Guests are prohibited from placing mobile phone, headphone or any other electronic device on gaming table while playing.
  • No dangerous or potentially hazardous objects, including but not limited to knives, guns, weapons etc., are permitted in the casino.
  • Guests are not allowed to bring outside food into the Companies properties. No request, if any made for storage of outside food at the locker area will be entertained.
  • Photography and videography are strictly prohibited on any of the casino gaming floors  of the Company.
  • Smoking is permitted in the designated areas only.
  • Guests in an inebriated state will not be allowed entry onboard orinto  the casino of The Company.
  • Management reserves the right to refuse service of serving alcoholic beverages to Guests it believes are in an inebriated state. Guests found in an inebriated state inthe casino of The Company, will be asked to leave the premises, the discretion of which lies solely with the Management. Further, the Guests will be liable to pay damages and cleaning charges to The Company, (if any).
  • Service of alcohol is strictly prohibited on days designated as a No-Alcohol days by the Government of Sri Lanka.
  • Management reserves the right to remove Guests from the casino in case of unruly or disruptive behavior.
  • Debit and credit cards used by the Guests for carrying out transactions at the Property should have the name of the cardholder and should be supported by an original government issued identity proof.
  • Debit/credit cards belonging to joint account holders and/ or Company or third party or such other legal entities will not be accepted for purchase of casino chips
  • Any bank transfers or electronic transfer or wire transfer should be only from the individuals personal account who is ultimate beneficiary to whom gaming chips will be issued in to the Company’s Account.
  • The company has full rights to do all kinds of KYC verification of the Guests in compliance with Sri Lanka's anti-money laundering (AML) and countering the financing of terrorism (CFT) laws and regulations in force from time to time and maintain such records. The company has rights to submit such records to the Government authorities when asked for.
  • The company has full rights to provide CCTV footages of any guests to any Government agencies when specifically asked for.
  • No guest or person within the Company property shall engage in any of the following activities:-
  • soliciting for the purpose of prostitution or for any other unlawful purpose;
  • unlicenced moneylending or related activities;
  • drunken, disorderly or riotous behaviour;
  • illegal betting or gaming activities; or
  • any offence or illegal activities in contravention of any applicable law in Sri Lanka.
  • The Guests shall take care of their valuables and belongings and in case of any loss, the Management will not be responsible.
  • Guests with infants and kids are responsible for taking care of their children as well as handling the children on the properties of The Company. Kids’ room attendants and arcade staff are not responsible if any infant or kid is hurt/ harmed in any way. A female guardian must be present with children under the age of 5 years. Entry to the children’s room is on a ‘first come first served Basis’ and is subject to availability.
  • Any unclaimed valuables and/or belongings for more than 15 (fifteen) days at the casino of The Company shall be confiscated and the Management shall not be responsible. Loss of baggage tags will not be entertained by Management.
  • The use, transportation, or possession of illegal drugs or narcotics (including marijuana) or of any other contraband, or the participation in any other anti-national or unlawful activity is strictly prohibited.
  • In case any Guest is found in possession of illegal drugs or narcotics (including marijuana) or of any other contraband then the Management reserves the right to remove the Guest from the premises as well as report the same to the authorities. In the event, the Guest is required to vacate the premises for contravention of the above rule, he/she will not be entitled for refund of any fee paid and/or any expenses incurred at the properties of The Company.
  • Valet parking will be done only at car owner’s request. In case any damage or theft occurs during the period when the vehicle is in valet parking, the Management will not be responsible, for the same.
  • The loss of valet parking tags will not be entertained by the Management.
  • These terms and conditions apply to the Guests who use the online services provided for any payment made to the Company. Guests must read these terms and conditions carefully. By authorizing a payment to the Company through any service provider ("the Service"), it would be treated as a deemed acceptance of these terms and conditions. The Company reserves all the right to amend these terms and conditions at any time without giving prior notice. It is the responsibility of the Guest to have read and understood the terms and conditions before availing the Service.
  • Payments using the Service may be made by using card credit, debit cards, net banking, payment wallets and UPI.
  • The Company is not directly involved in the online transactions but through a third-party service provider.
  • Upon completion of a transaction using the Service, the Guest will be presented with a confirmation screen verifying the transaction details which the Guest may wish to process. It is the sole responsibility of the Guest to verify that the transaction information and other details are correct.
  • The Company shall have no liability for transactions which are incorrect as a result of inaccurate data entry in the course of the use of the Service by the Guest or for loss of data or information caused by factors beyond the control of the Company.
  • The Guest will receive a confirmation email/SMS/WhatsApp once the payment has been received by the third-party service provider which will have the ‘Transaction ID’/ ‘QR Code’, as the case may be.
  • Every payment made will be verified by the Company using the ‘Transaction ID’/ ‘QR Code’ received by the Guest while executing the payment and a separate transaction receipt will be generated with ‘Transaction ID’/ ‘QR Code’ as the case may be, confirming the receipt of payment.
  • The Company shall not be responsible for decline, refusal, or reversal of payments, which shall be a matter between the Guest and the credit card or debit card issuer bank or the third-party service provider. In case, the transaction amount reflects/credited in the Company bank account on declined transactions, the Company shall only be responsible to initiate reversal of the said amount within 15 (fifteen) working days from the transaction. The Company shall not be responsible for delay on part of the card issuing bank. Further, the Company shall not entertain the request for payment in any other mode except for reversal of the transaction through the same mode of transfer.
  • Cancellation or refund will be solely executed as per cancellation and refund terms mentioned below.

 

  • No refund will be processed if a Guest utilizes his/her one-time play coupons or match play coupons offered to them as part of his/her package.
  • For every refund executed will have a separate refund receipt generated acknowledging the refund from the Company.
  • Once the Company receives the  refund request, the same will be scrutinized and the transaction will be evaluated. Only after approval of the Company, the refund will be initiated through any akin service provider. The refund will be processed as per the time frame mentioned below.
  • Refunds shall be processed in the same payment form that was used for the payment. Once an online refund request is generated, the same will be processed as per the time frame mentioned below.

If the standard timeframe as mentioned above has lapsed and the Guest has still not received the refund, the Guest will be required to contact his/her bank for details/ information in relation to the refund. For any questions about the refunds policy, please contact us at:

 

  • OTPC is for One Time Use only and can be played on non-commission live games which offer even payments (1 to 1).
  • OTPC cannot be played on opposite betting areas simultaneously.
  • For example – Simultaneous bets on Red & Black/Even & Odd in Roulette.
  • OTPC cannot be played on Slot Machines, Poker, and Indian Flush (Teen Patti).

By accepting these terms and conditions you have accepted that the Company can share/use your details such as personal details, pictures, etc. for the Company promotional videos or posters.

All terms and conditions, offers, clauses mentioned herein are subject to change as per the Management’s sole decision, as may be deemed fit by it.

Set forth below are the terms and conditions of the Company pertaining to carriage of guests, baggage and articles thereof undertaken by the Company, acceptance, or use of the minimum guaranteed purchase of food, beverages and gaming coupons shall constitute the agreement of the Guest to these terms and conditions.

The liability of the Company in the event of death or bodily injury suffered by a Guest shall be governed solely by the Insurance Policies as taken by the Company and shall never exceed the limitation of liability to which the Company are entitled under the Insurance policy. No undertaking, guarantee or warranty is given or shall be implied as to  any food, drink, medicine, or provisions supplied  in the casino. In no event shall the Company be liable for any incident arising outside the Guest areas of the casino, including, but not limited to those occurring outside the area owned by the company.

The Guests hereby releases the Company from any and all liability for any loss of life, injury or damages which is proximately caused by pregnancy, a pre- existing sickness, disease, infirmity disability or illness, whether mental, physical or otherwise of the Guest.

The Company shall be entitled at any time to cancel or to cease operations by reason of an event of force majeure, which shall include (without limitation) war or threat of war, terrorist activity or the threat of the same, riots, civil commotion, disaster, act of God, natural and nuclear disaster, fire, pandemic, epidemic, closure of ports, strikes, lockdowns declared by the Government or other industrial action and any other event outside its reasonable control and in such situations Company shall not be liable to the Guest for failure to perform its obligations mentioned hereinabove.

The Company shall be entitled at any time, without giving any reasons, to refuse entry, passage, to any Guest, whom the Company consider unfit  or a nuisance or likely to cause mischief by reasons of over consumption of alcohol or drugs or likely to inconvenience, endanger or impair the health, safety or reasonable comfort of any person  or likely to endanger or impair safety of the  casino or under look out by Government Agencies, designated terrorist, fugitive or suspected in any kind of criminal activity or politically exposed person.

If at any stage it is found that the casino floor is overcrowded, the Company reserve the right to decide which Guest shall be removed and such decision of the Company shall be binding and final.

The purchase of a minimum guaranteed food, beverages and gaming coupons by the Guests shall be subject to the existing rules made by the Company.

The Guest covenants, represents and warrants that he/she is, not in any way a nuisance and that his/her conduct will not in any way cause any mischief or inconvenience, endanger, or impair the health, safety or reasonable comfort of any person or persons whether on board or not, or endanger or impair the safety of the casino.

The Guest shall be liable to and shall reimburse the Company for all damages to the casino caused directly or indirectly, in whole or in part, by any act or omission of the Guest, whether willful or negligent. The Guest shall further indemnify the Company against all liability whatsoever arising from any personal injury, death or damage or loss whatsoever caused directly or indirectly, in whole or in part to the said Company, by any willful or negligent act or omission on part of the Guest.

The Guest is subject to mandatory security check and agrees and hereby consents to search and security check being made of the Guest's person and property whether physically, by way of screening, scanning or otherwise and to the sequestration of any property, which may, in the opinion of the Company and/or any officer, likely in any way to inconvenience, endanger or impair the health, safety or reasonable comfort of any person or persons whether on board or not, or endanger or impair the safety of the casino.

Guests are always expected to conduct themselves in a proper manner and with due regard to the health, safety, comfort, enjoyment and general well-being of all persons in the casino premise involved in the provision of any service or facility forming part of the casino or properties managed and owned by The Company.

The Guest must not carry as baggage or bring compressed gases, corrosives, explosives, ammunitions, fireworks, inflammable article or substance of any kind, weapons, scissors, sharp instruments, radioactive materials, oxidizing materials, poisonous substances, magnetized materials, and any other dangerous articles/ or chattel as may be deemed by the Company ("Prohibited Articles"). Guests shall be liable for all penalties imposed under applicable statutes and for all damages and losses sustained whether by the Company, the casino, or any person or property or otherwise by reason or in consequence of any Prohibited Articles being brought or carried into the casino.

The Guests are instructed not to accept any packets/packages from unknown Guests and are further instructed not to abandon baggage/articles in the premises of the casino. Unattended baggage/articles may be removed by the personnel of the Company as an object of suspicion and shall be confiscated. Any claim for the said baggage/articles will not be entertained.

Any claim for the loss of life or injury or loss of or damage to property of the Guest shall be notified to the Company in writing ("Notice of Claim") within thirty (30) days from the date when the loss of life or injury occurred or as soon as the loss or damage to the property of the Guest is discovered. The Notice of Claim shall be served on the Company at its registered office: Lotus Tower, 320 D R Wijewardane Mawatha, Colombo 10, Sri Lanka.

Guests under the age of 21, booking the adult packages through an online portal shall be allowed for availing of only kids’ package and no money shall be refunded.

Guests shall not pay any sums to any agent/person claiming to be the Company representative for the purchase of chips, food and beverages or any other services. The Company shall not be responsible for any payments made by Guests on his/her own volition to any agent/third party, falsely claiming to be the representative of the Company. All payments should be affected only to the official bank accounts of the Company.

Guests are hereby informed that Golden Island Hospitality Pvt Ltd. does not solicit any investment, partnership, dilution of shares, table sharing/renting or any other kind of investment. Any Guest dealing with any agent/person soliciting investment in the Golden Island Hospitality Pvt Ltd Company shall do so at his/her own risk.

Guests are hereby informed that Golden Island Hospitality Pvt Ltd does not operate, associate, collaborate, promote, or run any online gaming app. Any Guest dealing with any such app claiming to be associated with The Company shall do so at his/her own risk and shall be solely responsible for the consequences of such dealings.

Any payments made to the Company shall only be against the issue of chips, food and beverages, rooms tariffs, and other services provided by the Company. For all payments made at the casino and for which the gaming chips are issued, the service is deemed to be incurred irrespective of the fact that the Guest wager with the said chips, win/loss and or encashed. Under no circumstances Guest shall claim that the said payment should be treated as investment/partnership in the Company or Golden Island Hospitality Pvt Ltd.

Guest making any payment towards any service like food and beverages, gaming chips, rooms, spa etc. declare that such payment is made from their legitimate wealth/income/savings. The Company shall not be responsible for the legitimacy of the source of funds, subsequent disputes between Guest and third parties or origin of the funds as the Company have no reason to prima facie doubt the legitimacy of the source of the funds used at the casino towards purchase of gaming chips or such other services as above mentioned. Once the gaming chips are issued and or other services are rendered, the Company shall not be responsible for a refund of such amount.

The Company strictly adheres to the provisions of the Sri Lanka’s Prevention of Money Laundering and Countering the Financing of Terrorism Act, subsequent amendments, regulations and rules made there under and other reporting requirements, as may be issued from time to time. Guests are hereby informed that the Company does not solicit parking of any of the funds belonging to the Guests. Once the gaming chips are issued and other services are provided and goods and service tax is paid on such services, the said amount paid to the Company shall deemed to be income of the Company and the Company shall become sole owner of the said amount. Accordingly, no such payments shall be treated as funds parked with the Company whether or not the same is out of any proceeds of any alleged or proven crime.

Disputes if any, shall be subject to the jurisdiction of courts in Colombo, Sri Lanka only.

The purchase of food, beverages or playing coupons/ invoices shall be governed by and construed in accordance with the laws of Sri Lanka.
